Refund Policy
Contents
1. Scope
This Refund Policy explains when Breneshold LLC ("Witnio", "we") refunds charges paid for the Witnio service (the "Service"). It forms part of, and is read together with, the Terms of Service, in particular section 11 (Billing, renewal and payment failure) and section 12 (Cancellation, refunds and trials).
This page restates the refund rules of the Terms and explains how to request a refund. It creates no refund right beyond those stated in the Terms. If this page and the Terms differ, the Terms prevail.
2. General rule
Charges are non-refundable except in the cases described in sections 3 to 5 of this page, each of which is stated in the Terms.
Witnio does not refund the unused part of a period on cancellation (section 6).
3. Automatic refund when a paid service cannot be activated
If Witnio cannot activate a service you have paid for within 24 hours of payment because it lacks the capacity to provide it, Witnio closes the activation request and refunds that charge in full, automatically and without any request from you, to the original payment method.
- The 24 hours run from payment. Until then Witnio retries the activation automatically; if capacity becomes available within that time, the service is activated and no refund applies.
- The refund covers the full amount charged for that service and is returned through the payment provider that processed the payment.
- Witnio sends a confirmation to the contact address of the activation request, or of your Account, when the refund is issued.
- The time the refund takes to appear on your statement depends on your payment provider and your bank and is outside Witnio's control.
- If the automatic refund cannot be completed, Witnio is alerted and follows up to complete it. You may also contact us as described in section 8.
4. Refund for unavailability caused by Witnio
Where the Service was unavailable for a continuous period caused by Witnio, you may request a pro-rata credit or refund of the subscription fee for the affected period.
Unavailability caused by your own systems, your provider, a carrier, a target site, a maintenance window, a suspension under the Terms, or an event of force majeure is not Witnio-caused and does not qualify.
A request must be made within 30 days of the affected period and is settled against Witnio's own operational records, which you may ask to see for the period in question.
5. Other refunds stated in the Terms
- Changes to the Terms: if a change materially reduces your rights, you may terminate before it takes effect and receive a refund of the unused prepaid fees (Terms, section 23).
- Force majeure: if a force majeure event continues for more than 30 consecutive days and either party terminates the affected subscription, Witnio refunds the unused prepaid fees for the period not delivered (Terms, section 26).
6. Cancellation
You may cancel at any time from your Account. Cancellation takes effect at the end of the period you have already paid for: your Plan stays active until then and is not renewed. Witnio does not refund the unused part of a period on cancellation.
7. Trials
A free trial exists only where your Order expressly offers one; trials are not offered by default. A trial confers no refund rights and converts to nothing automatically.
8. How to request a refund
Send your request to [email protected], or open a support request from the Support section of your dashboard. Include the email address of your Account, the invoice or charge concerned, the affected period and the reason for the request.
We aim to reply within one business day. This is a target, not a service level; section 16 of the Terms applies.
Approved refunds are returned to the original payment method.
A billing dispute must be raised within 60 days of the invoice date; after that the invoice is treated as accepted (Terms, section 11).
9. Changes and language
Witnio may update this policy. The version in force and its date appear at the top of this page. A change that reduces your refund rights under the Terms follows the notice rules of section 23 of the Terms.
This policy is published in English and in Spanish. The English version prevails in the event of a discrepancy, to the extent permitted by Florida law.
